Court of Protection

If someone is incapable of managing their own financial affairs because of a mental disability the Court of Protection, a part of the Public Guardian Office, will take on this duty for them. An application is made to the Court of Protection for a Receiver to be appointed. The applicant can be a relative, friend, local authority officer or a professional advisor.

If no one is willing to act, the Public Trustee can be appointed as a last resort. If the Court is satisfied that there is a need for a Receiver to be appointed and has medical evidence to support this, it will give the Receiver specific powers to deal with the person's affairs. The Receiver has to keep accounts and make an annual return to the Court. The Receiver can recover a fee from the person whose affairs need managing.
